If the police read you your rights... YOU ARE THE TARGET OF AN INVESTIGATION... which means BE QUIET for those of you that need stronger language, SHUT UP!!!
When an officer reads you your "Miranda Rights" you are told ANYTHING you say can and will be used AGAINST YOU in a court of law. Yet time and time again people don't keep quiet. Why? Usually because the officers will say, "Listen this is your opportunity to talk to us and tell us your side." Followed by, "if you don't tell me what I need to know I won't be able to help you out with the judge later on."
Stop people and think!! If the officer is arresting you and telling you ANYTHING you say can and will be used AGAINST YOU, he means it. This is not your opportunity to tell your side of the story. The Supreme Court has ruled that police officers are allowed to LIE (the word they use is "MISREPRESENT") to suspects to further an investigation.* Most people however, are not aware of this.
Once you make a statement to police you cannot take it back and it makes your case more difficult to defend, EVEN IF YOU ARE INNOCENT!
It is human nature to want to explain things and it's for this reason that police officers want to get you and keep you talking. So remember, if for whatever reason you find yourself in the unenviable position of hearing your Miranda Rights by law enforcement, BE QUIET!
It is not your job to tell your side of the story, that's what you have a lawyer for.
*A police officers 'misrepresentation' will be analyzed by the courts using the totality of the circumstances.
